THIS CONTRACT SERVICES AGREEMENT (herein "Agreement") is made and
entered into this day, by and between the Litchney Law Firm, A Professional Law Corporation (herein "Law Firm or Attorney") and purchaser (herein "Customer").
NOW, THEREFORE, the parties hereto agree as follows:
SERVICES. You will get a personal consultation with one of our experienced Real Estate Attorneys; this consultation is to answer any questions you may have about your decisions, your options and also, depending on where you are in the foreclosure process making sure the lender followed the law perfectly. If they did not, you may have a case against them.
HomeFree Walk Away Toolkit™. Includes legal information, but not legal advice. It is a collaboration of legal information pertaining to common real estate issues including foreclosure, and all of the options to either stop foreclosure or voluntarily foreclose. The toolkit also contains useful correspondence to your lender, a form letter instructing them to stop calling you.A detailed time-line, showing all the steps that will occur during the foreclosure process.The state laws pertaining to your foreclosure.How to make sure your lender follows the law. Discussion about credit, the effects on your credit score and credit repair, and beneficial information regarding bankruptcy.
FEE FOR SERVICES. For the services rendered pursuant to this Agreement,Law Firm shall be compensated a total of $745.00 which includes the toolkit ($495 value) and the 20 minute question and answer session (hereinafter consultation) with an attorney ($250 value).
LEGAL INFORMATION. With the purchase of our toolkit and consultation, you get a consultation with an attorney who will give you legal advice. However, the information you receive from Law Firm in the toolkit is to inform you about foreclosure law and is designed to help you safely deal with your own legal needs and is considered legal information and not legal advice, so please do not rely on it as such. Please note and be aware that legal information is not the same as legal advice. The law as it applies to each individual varies with specific circumstances.
NOTICE: You have purchased our HomeFree Walk Away Toolkit™ as well as a one on one consultation with one of our attorneys. Your purchase of our toolkit is for legal information ONLY and not legal advice, this purchase did not create an attorney-client relationship; your purchase of a twenty minute consultation with one of our attorneys will provide you with legal advice specific to your situation and will create an attorney-client relationship ONLY for the duration of the consultation. Once the consultation is over the attorney-client relationship will be considered severed, you will not be able to ask additional questions without incurring additional charges and you will be considered a past client of our firm, but your personal information will be retained in case you need us again in the future.
PROPRIETARY RIGHTS. You are permitted to read the content delivered to you through the Law Firms developed toolkit. You may notcopy, reproduce, distribute, or create derivative works from this content. Further, you agree not toreverse engineer or reverse compile any of Law Firm technology or printed material or legal information. You may not resell this legal information to any other user. The toolkit is copyright protected and all material within is protected by United States Copyright law and United States Trademark Law. Any infringement will be pursued and dealt with strictly up to the highest limits allowed by law.
USER CONDUCT. You agree not to use Law Firm or the content or information delivered through Law Firm in any way that would: (a) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (b) be fraudulent or involve the sale of counterfeit or stolen items, including but not limited to use of Law Firm to impersonate another person or entity; (c) violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (d) be false, misleading or inaccurate; (e) create liability for Law Firm or its affiliates or cause us to lose (in whole or in part) any services of any third-party provider; (f) be defamatory, trade libelous,unlawfully threatening or unlawfully harassing; (g) interfere with or disrupt the use of Law Firm by any other client or customer; (h) access the information and content manually by request and not programmatically by macro or other automated means; or (i) use Law Firm in such a manner as to gain unauthorized entry or access to the computer systems.
RESTRICTION ON CONSUMER USE OR RETAIL. You agree not to resell or make any commercial or other personal use (for purchase or sale) of the services in our toolkit.
YOUR INDEMNIFICATION OF LAW FIRM. When you use Law Firms services and legal information and advice, unless caused by our intentional misconduct or grossnegligence, you agree to protect and fully compensate Law Firm and our attorneys, staff, service providers and affiliates from any and all third party claims, liability, damages, expenses and costs (including, but not limited to, reasonable attorneys fees) caused by or arising from your use of our services or legal information, your violation of this Addendum or your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone.
Residency. You assert that you are either a resident of California or a homeowner with real property located in the State of California. As attorneys we cannot assist those who do not have the above ties with California.
The purchaser and all other users hereby agrees to and acknowledges the above.
100% Money Back Guarantee Terms:
If within 30 days from purchase the Customer is not 100% satisfied with the purchase of the toolkit Customer may request a refund for 100% of the toolkit fee. In order to receive a refund Customer must ask for a refund in writing as below and must also return to Litchney Law Firm at the below address in great condition the toolkit without any marks, damage or highlights present. If Customer also purchased an attorney consultation, no refunds will be made for either the toolkit or the consultation after the consultation has been completed. Any additional purchases from Litchney Law Firm forfeits any future right to receiving a refund. All refunds will be in the form of a check or a credit card back to the same card charged for the fee. The type of refund used will be solely up to Litchney Law Firm, P.C. Due to administrative and processing times refunds will be made within 90 days of receipt of your valid written request letter and the return of the toolkit, whichever is later.
